Thoughts and Views of the Ukrainian Population on Judicial Reform: September 2018

Presentation

From September 12 to 24, 2018, the Kyiv International Institute of Sociology (KIIS) conducted an all-Ukrainian public opinion polling commissioned by the client. By the method of personal interviewing, 2011 respondents who live in 110 settlements of all regions of Ukraine (except Crimea) were polled by a 4-step stochastic sample that is representative for the population of Ukraine under the age of 18.

In Luhansk and Donetsk regions, the poll was conducted only on the territory controlled by the Ukrainian authorities.

The statistical sampling error (with a probability of 0.95 and a design effect of 1.5) does not exceed: 3.3% for indicators close to 50%, 2.8% - for indicators close to 25%, 2.0% - for indicators close to 10%, 1.4% - for indicators close to 5%.

The main results of the survey

Eurointegration strivings of the Ukrainian population and the priority of judicial reform after the Revolution of Dignity

  • In the case of a referendum on EU membership, 47.9% of the country's population would vote "for", 25.1% would vote "against", and 11.5% would abstain and not vote. Another 15.5% of the respondents haven’t decided yet or refused to answer the question. Thus, 65.7% of Ukrainians who would have participated in the referendum would vote for joining the European Union.
  • To the question "Was the reform of Judicial System needed after the Revolution of Dignity in 2013-14?" 40.5% of respondents said that "yes, and this was one of the most urgent tasks." Another 35.2% of respondents chose the option "yes, but this was not the most important task / were other, more relevant reforms." The share of those who believe that there was no need for the reform - 4.6%. Another 19.7% of the respondents haven't decided or refused to answer the question.

 

Trust in the courts of Ukraine

  • o The Ukrainian courts are more likely or completely trusted by 12.3% of Ukrainians, and not trusted - 78.5%. Another 9.2% of respondents did not determine their opinion, or refused to answer.
  • o At the same time, with the question "How has your attitude toward the courts of Ukraine changed over the past 3-4 years?" 31.3% of respondents said their attitude deteriorated, 2.7% - improved. Another 58.1% say that their attitude has not changed, and 7.9% have not determined their opinion or have refused to answer.

Awareness of judicial reform, expectations from the implementation of judicial reform and assessment of the implementation of judicial reform

  • 73.3% of respondents at least heard that judicial reform was being implemented in Ukraine in recent years, while 26.7% said they did not even hear about it at all. At the same time, 73.3% of them say they know quite well about the main provisions of the reform - 3.9%. Another 22.7% say they are aware of some of the provisions of the reform, while 46.7% said they had only heard about the reform but did not know about its provisions.
  • On the question "What changes in the judicial system of Ukraine would you expect to see as a result of successful judicial reform?" among all respondents (all respondents were asked, regardless of the awareness of the current reform), the following choices were most often selected:
  • To deprive judges of immunity and privileges - 53.2%;
  • introduce legal liability of judges for illegal decisions - 49.4%;
  • improving access to justice - 43.9%;
  • reduction of court cases - 40.5%;
  • implementation of the verification of judges by a lie detector - 40.4%;
  • speed of execution of court decisions - 38,8%;
  • release of a part of judges, re-certification of judges - 34.7%;
  • introduction of judiciary elections, so that local residents choose them - 30.4%.
  • o Among the respondents who at least heard about judicial reform, 0.9% consider it to be quite successful, 10.2% - successful in general, although there are some negative aspects. At the same time, 23.7% consider it to be generally unsuccessful, although there are some positive aspects, while 44% are of the opinion that the reform was completely unsuccessful. Another 21.2% of the respondents couldn't decide or refused to answer the question.
  • o Respondents who at least heard about judicial reform also asked the question "Which of the following, in your opinion, has already been implemented / will be implemented after the completion of judicial reform?" Below, in the table, for those who at least heard about judicial reform, the answers to the questions about the expected expectations of reform and the question of what they think have already been implemented / will be implemented as a result of the current reform are compared:

  • o To the question "What do you think is the main reason for the failure of the judicial reform?", which was addressed only to respondents who consider that reform is unsuccessful, 45% chose the variant "Corruption in the system of state authorities". 17.7% chose the variant "The attempt of the President of Ukraine to subordinate all branches of state power, in particular, officials responsible for judicial reform", 10.2% - "the opposition of the judges and the involved persons themselves, the mutual guarantee", 5,3% - " the struggle of political clans for sphere of influence ", 5.1% -" the unwillingness of deputies of the Verkhovna Rada to adopt the necessary laws ", 4.8% -" the collapse of the system of public administration in general ", 4.7% -" incompetence of officials responsible for the conduct of judicial reforms ". Other variants were chosen by respondents less often.
  • To the question "Who exactly, in your opinion, is most responsible for the failure to implement judicial reform?" among respondents who consider the reform unsuccessful, 51.8% chose the option "President of Ukraine Petro Poroshenko", 9.2% - "people’s deputy” , 7.6% - "Prime Minister of Ukraine Volodymyr Groisman", 7.5% - "Oleksii Filatov, Chairman of the Commission under the President of Ukraine on Judicial Reform." Other variants were chosen by respondents less often.
  • o Among those who consider the reform to be unsuccessful, 64.2% believe that officials responsible for the failure to reform should be prosecuted, 62.4% - that they should be dismissed with the prohibition of holding any state and elective posts, 51.1% - that they have to compensate for expenses, taken from the state budget, from their personal property.

The role of international organizations in judicial reform

  • o  46.4% of respondents believe that international organizations should participate in judicial reform, and 33.4%, on the contrary, are of the opinion that they should not. Another 20.2% have not chosen or refused to answer the question.
  • Among respondents at least heard of the judicial reform, 19.6% believe that international organizations "do not affect / not involved in the process of judicial reform," 30.7% - that they are "involved, but insufficiently", 10.5% - that "participate in a sufficient degree", 7.5% - that they "over-engage / have too much influence on the process of judicial reform". Another 31.8% haven't decided yet or refused to answer the question.
  • o Also among those who at least heard of judicial reform, 62.6% consider that funds allocated by international organizations for its implementation were not used for purpose. 10% believe that they were used by appointment, and 27.4% did not define their opinion or refused to answer the question.
